Sherwin C.W. YAMSenior Associate

Sherwin was admitted as a Solicitor of Hong Kong in 2017. Prior to joining Lily Fenn & Partners, she has over four years of solid practice experience in reputable local firms in Hong Kong. She has a broad dispute resolution practice involving family disputes, construction disputes, land disputes, contractual claims, companies' winding up, personal injuries, contentious probate actions, etc. In non-contentious areas, she also has experience in wills and probate, conveyancing and general commercial work.

 

Specifically, she has experience in handling complex matrimonial litigation and probate actions for high-net-worth clients. Her experience encompasses TL v ML procedure: Tackling the Preliminary Issue of Beneficial Ownership of Properties in Divorce Proceedings, opposition of variation of maintenance application, issuance of Judgment Summons against defaulting party for non-payment of maintenance, as well as commencing committal proceedings against divorced spouse for occupying the matrimonial property and land disputes.

 

Sherwin has wide experience in land litigation disputes. Her experience includes acting for registered owner of New Territories Land in property litigation, occupier in claiming adverse possessory title of old tenement, indigenous villagers in deregistration of old mortgage in New Territories Land to obtain Building Licences from the Government, etc. She also acted as trustee in an order for sale under the Land (Compulsory Sale for Redevelopment) Ordinance, Cap 545.

 

For alternative dispute resolution, she has experience in handling ad hoc arbitration proceedings involving construction disputes. She also previously assisted clients in mediation sessions.

 

Sherwin has experience in advising clients regarding interviews with law enforcement agencies and regulatory bodies such as ICAC, the Hong Kong Police Force and Immigration Department.

 

Sherwin actively contributes to the community by providing pro bono legal service.  She is a Solicitor on the Duty Lawyer Scheme and the Legal Aid Panel.

 

Sherwin holds a Bachelor of Laws with Honours and minor in Criminology at City University of Hong Kong. She was awarded Postgraduate Certificate in Laws at City University of Hong Kong. During her university studies, she participated in exchange programs at Monash University in Melbourne and University College in Oxford with focus on Intellectual Property Law and European Competition Law and Policy respectively.
